Leonid Antonienko: Everything is already ready to launch the lease under the new and transparent rules

On August 13, at a meeting with the participation of the Head of the Fund, his deputies and heads of the Regional Offices, the First Deputy Head of the State Property Fund of Ukraine Leonid Antonienko announced he full readiness to launch the lease of state property under new, transparent rules.

In his speech, Leonid Antonienko commented on the approved new forms of lease agreements. “New standard forms of agreement have some innovation in comparison with the previous ones.  It’s important that the balance holder becomes a party to a lease agreement and gets the opportunity to directly take care of his interests as a person receiving part of the rent on his accounts”, noted the First Deputy Head.

And what’s is more, the Resolution of the Cabinet Ministers of Ukraine that approved new standard forms of lease agreements is the last legislative instrumentrequired for the implementation of the Law on Lease, which came into effect on February 1, 2020.That is, everything is ready to start the processes of transferring property for lease at electronic auctions.

Beside, the First Deputy Head reminded the representatives of the regional offices of the Fund about the list of vacant objects in respect of which a decision was made to lease.These are 4262 vacant properties that are posted on the Fund’s website.Now regional offices are filling information about these objects in accordance with the Law on Lease.

For example, photographs of the object, as well as its floor plan, must be uploaded.Various documents are also loaded, such as:

-          The lessor’s decision to announce an auction, as a result of which the current lease agreement can be extended with the existing tenant or concluded with a new one;

-          The asset holder’s reference;

-          Independent appraiser report on the market value of inherent improvements;

-          Proposals for determining a longer lease term;

-          Invoices from utility providers that were issued in relation to the rental object in one of the three months preceding the date of filling in the information and others.

Now all information on leased objects is uploaded to the internal database of the Fund, but it is disclosed on its official website.In the near future, all this data will be transferred to Prozorro.Sale.

In his report, the First Deputy Head of the Fund dwelled on the possible timing of the start of the first auctions for the lease of state property.So, taking into account all the requirements of the legislation, the maximum period from the moment the lessor decides to include the leased object in the List of the corresponding type at the request of the potential tenant until the announcement of the auction is published in the electronic trading system (ETS) is 20 working days.The auction must hold within 20-35 calendar days from the date of publication of the announcement in the ETS.In general, the terms for concluding a lease agreement for a specific object are from 80 to 140 days.
